Art. 1 ORGANIZADOR

Este proyecto de recomendación (en adelante denominado "el Proyecto") está organizado por Atlantic Education Services Ltd, con domicilio social en Unit - G5, 129 Mile End Road, Londres, Reino Unido, E1 4BG, registrado con el nº. 09193501 (en lo sucesivo, el "Organizador") en los términos de este reglamento (en lo sucesivo, el "Reglamento").

 

Art. 2 DURACIÓN DEL PROYECTO

El proyecto tiene lugar a partir del 1 de julio de 2022, por un período indefinido. El organizador se reserva el derecho de poner fin al Proyecto en cualquier momento, informando previamente al público a través de la página web www.atlanticlondon.ro al menos 5 días naturales antes de la terminación efectiva del Proyecto. En caso de terminación del Proyecto en las condiciones anteriores, las recomendaciones enviadas hasta la fecha de terminación efectiva del Proyecto se considerarán válidas y estarán sujetas a las condiciones del presente Reglamento.

 

Art. 3 PARTICIPACIÓN

La participación en el Proyecto está abierta a cualquier persona física, independientemente de su nacionalidad, que haya cumplido 18 años en la fecha de transmisión de la recomendación (el "Participante") y que, durante la duración del Proyecto, haya recomendado a otra persona, cumplimentando correctamente una recomendación electrónica facilitada por el Organizador. Los empleados del Organizador o los colaboradores del equipo de Marketing no pueden tener la condición de Participantes en este proyecto.

 

Recomendación del art. 4 RECOMENDACIÓN

Una Recomendación, en el sentido de este Reglamento, es cualquier persona que, en el momento en que el Organizador recibe los datos del Participante, no es ya cliente del Organizador, para cualquier servicio ofrecido por el Organizador.

 

Art. 5 MÉTODO DE DESARROLLO DEL PROYECTO

El organizador pone a disposición de los futuros Participantes de forma gratuita el formulario electrónico, que se puede rellenar en la página web www.atlanticlondon.ro, en la sección "Recomienda a un amigo".

Los participantes completarán los datos en formato electrónico con información correcta y completa, aportando necesariamente la información marcada con el signo *. Al recibir la recomendación, el Organizador incluirá los datos de esta persona en su base de datos y se pondrá en contacto con ella por teléfono para presentarle la oferta de servicios y proponerle ser cliente del Organizador para estos servicios.

 

Art. 6 RECOMPENSACIÓN

Si el Participante cumple las condiciones del Proyecto, para el envío de la recompensa, el Organizador confirmará con el Participante, por correo electrónico o SMS, la dirección a la que desea recibir la Recompensa. Si en el plazo de 10 días naturales a partir de la fecha de envío del mensaje, el Organizador no recibe la información solicitada, el Participante pierde la condición de ganador. El Organizador enviará las recompensas al Participante en un plazo de 30 días hábiles a partir de la fecha de aceptación por parte del SLC de la solicitud del Participante, siempre que el Participante comunique al Organizador toda la información necesaria para que éste pueda cumplir con sus obligaciones legales y enviar la recompensa por mensajería. 

 

Si, en un plazo de 150 días naturales a partir de la recepción de la Recomendación por parte del Organizador, un Participante se convierte en cliente del Organizador por sus servicios, el Organizador concede a dicho Participante una recompensa de acuerdo con la siguiente tabla:

 

Un Participante puede acumular un número ilimitado de estas recompensas.

Esta tabla de recompensas es válida a partir del 1 de julio de 2022 y se aplicará a todos los Participantes que tengan derecho a la recompensa después de esta fecha.

 

Art. 7 INFORMACIONES

Los participantes tienen la obligación de que toda la información que proporcionen a través del Proyecto sea verdadera, precisa y completa. El Organizador advierte a los Participantes que la información errónea no será tenida en cuenta para otorgar a una persona la condición de Participante y/o las recompensas del art. 6 anterior y no comprometerá la responsabilidad del Organizador en las relaciones con los Participantes o con terceros. Si el Organizador comprueba que un Participante no ha cumplido y/o no ha respetado las condiciones de Participación previstas en el presente Reglamento, se reserva el derecho de no tener en cuenta la recomendación dada y de suspender la participación del Participante en el Proyecto, sin que el Organizador deba ninguna compensación o pago de la recompensa.

 

Art. 8 DATOS PERSONALES

Through these Regulations, the Organizer undertakes to comply with the provisions of the legislation on the protection of personal data, including the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to data processing and the free circulation of these data and the repeal of Directive 95/46/CE (GDPR). The organizer is the operator of personal data. The categories of the persons concerned and the categories of personal data processed. The organizer will process the personal data of the following categories of concerned persons: a) Participants b) Contact persons within the Recommended Companies. The personal data collected are: name, surname, mobile phone, email address, and home address. Personal data are processed for the following purposes: a) Organization and development of the Project and the awarding of rewards to participants in the Project, the use of personal data of participants for promotional and advertising purposes in connection with the announcement of participants and the transmission of rewards, the transmission of commercial communications regarding the Organizer’s offers, invitations to participate in contests, etc. b) Payment of related taxes and other obligations according to the law. c) Solving complaints in connection with the organization and development of the Project and awarding rewards, investigating possible violations of the Regulation, carrying out analyses, reports on the organized marketing campaigns; the telephone conversations made by the Participants can be recorded in order to improve the services offered, as well as to check how the complaints addressed were resolved or in case of litigation/disputes related to the development of the Project. d) Other activities provided by law, (e.g. archiving, etc.), e) If the persons concerned give their consent for the processing of personal data, they have the right to withdraw this consent at any time. Participants who refuse to communicate or withdraw their consent for the processing of personal data necessary for participation in the Project will not be eligible to participate, respectively to receive the reward. The organizer can disclose personal data to: a) its partners, acting either as Operators or as authorized persons (e.g. notaries public) b) providers of marketing services, courier services, mobile telephony, etc. Personal data will be kept as long as necessary to fulfill the purposes for which they were collected according to this Regulation, and/or, if applicable, according to the duration imposed by the applicable legal requirements. The participants, as well as the contact persons, benefit from the following rights: a) The right of access: The participants can request from the Operator confirmation that he processes their personal data or not, as well as information about how they are processed. b) The right to rectification: Participants can request the rectification of inaccurate personal data or the completion of incomplete personal data. Participants may request any available information regarding the source of the personal data, and may also request a copy of the processed data. c) The right to erasure: based on the right to erasure, Participants can request the erasure of their personal data in cases where: (i) the data is no longer necessary in relation to the purpose of the collection or processing; (ii) choose to withdraw their consent; (iii) oppose the processing by automated means using the technical specifications; (iv) personal data were processed illegally; (v) there is a legal obligation to delete the personal data; (vi) deletion is necessary to ensure compliance with applicable laws. The right to deletion does not apply if the Organizer has the obligation to keep the data according to a legal provision. d) The right to restrict processing: Participants can request the restriction of processing in cases where: (i) they dispute the accuracy of personal data; (ii) the Organizer no longer needs the personal data, for the purpose of processing; (iii) have refused processing for legitimate reasons. e) The right to data transfer: Participants may request, if necessary, the portability of the personal data they have provided to the Organizer, in a structured, commonly used and easy-to-read manner, and have the right to transmit this data to another Operator without the Organizer refusing if: (i) the processing of personal data is based on consent or contract; and (ii) the processing is done by automated means. They can also request the direct transmission of personal data to a third party of their choice (if technically feasible). f) The right not to be subject to a decision based solely on automated processing that produces legal effects: Participants have the right not to be subject to a decision based solely on automated processing that produces legal effects. To exercise the rights mentioned in points a-f, the Participants can send a written, dated and signed request to: [email protected] or to the headquarters of the Organizer mentioned in art. 1 above. g) The right to file a complaint with the competent supervisory authority. By completing the electronic Recommendation Form, the Participant gives his consent to the processing of his personal data for the purpose described in these Regulations and at the same time guarantees to the Organizer that he has previously obtained the consent of the contact person regarding the processing of his personal data.

 

Art. 10 CONTROVERSIAS

Cualquier disputa que surja entre el Organizador y el Participante se resolverá de forma amistosa o, si esto no es posible, se someterá a la resolución de los tribunales competentes de acuerdo con la legislación aplicable.

Cualquier posible impugnación sólo podrá ser formulada por escrito por el participante a la dirección de correo electrónico [email protected]. El recurso se resolverá en un plazo máximo de 30 días desde su recepción, y la resolución se enviará al recurrente por escrito. Si el recurrente está insatisfecho con la decisión, se intentará una resolución amistosa del recurso, y si esto no es posible, las disputas serán resueltas por los tribunales competentes.

 

Art. 11 FUERZA MAYOR Y CASO FORTUITO

A los efectos del presente documento, se entiende por Fuerza Mayor el acontecimiento externo, imprevisible, absolutamente invencible e inevitable, que tiene la naturaleza de exonerar de responsabilidad a la parte que lo invoca. Por caso fortuito se entiende aquel acontecimiento no previsible ni evitable por el Organizador, que tiene la naturaleza de exonerar de responsabilidad a la parte que lo invoca, incluyendo las deficiencias de carácter técnico y cuya ocurrencia hace que ésta no pueda y cumpla con las obligaciones asumidas por el documento. La categoría de estos eventos incluye, pero no se limita a: guerras, incendios, inundaciones, huelgas y bloqueos, terremotos, otras catástrofes de cualquier tipo, así como cualquier regulación que pueda aparecer después del inicio del Proyecto y que pueda prohibir o modificar este Reglamento. 

Si una situación de fuerza mayor/acontecimiento extranjero, incluida la imposibilidad del Organizador por razones independientes de su voluntad, impide o retrasa la ejecución total o parcial del Reglamento y la continuación del Proyecto, el Organizador quedará exonerado de la responsabilidad relativa al cumplimiento de sus obligaciones durante el período en que dicho cumplimiento se vea impedido o retrasado.

 

Art. 12 REGLAMENTO DEL PROYECTO

Este Reglamento está disponible gratuitamente en el sitio web del Organizador durante toda la duración del Proyecto. La participación en el Proyecto implica la aceptación sin reservas por parte de los Participantes de todas las disposiciones del presente Reglamento. El organizador se reserva el derecho de modificar el Reglamento, no sin antes informar al público en un plazo razonable a través de su página web sobre la(s) modificación(es).
